The society in which I am staying is charging Car Parking Charges from only those members who have not purchase car parking area from builder and are parking car in open parking area. There are no car parking charges levied on the members who have purchase the car parking area from builder. The argument is the members have paid lacs of rupees to purchase car parking from the builder and hence there should not be car parking charges from them. This is not correct in my opinion. There are monthly expenses on car parking area for example property tax, electricity charges, water charges, sweeper charges, etc which is paid from the common society bank account in which all members pay their maintenance bills equally (per square feet) irrespective of whether he owns the car parking space from builder or not

Earlier we had provisional committee. The chairman alloted 11 parkings to flat members without approval from MC nor did he alloted it in SGBM or GBM. In one of the SGBM he did mention about alloting the parking on first come first basis and fixed notice on notice board and also mailed to the members on their email id. He did alloted directly to the members in which he alloted 3 parkings to himself. So is it proper and did he allot it rightly. He have taken a underwritten from 11 members saying in future society can anytime take the parking back if they feel something wrong but now he not ready to surrender. He saying parking alloted by him is for lifetime. So can the new committe the parking back from all the committee member and allot it freshly in transparent way like for a year and so and getting some benefit like rent for parking. The old chairman said if parking taken back will challenge the same in court and will get all the parking given by builder cancelled. So is it possible.

I am a registered member of CHS, Maharashtra, Mumbai, Mahim West - 400 016. The car parking space is limited and is OPEN PARKING, and 3 cars can fit inside the parking area, but there are 4 cars currently and the 4th one is mine. I have asked the society to let everyone enjoy the parking in Rotational pattern, but they did not respond to my query, so I stressed them with another letter regarding the same and they created a fuss of the matter saying that I am being a dictator. They are not allotting me the parking space even on rotational basis, the parking space being OPEN PARKING. What is the legal provision to take this matter ahead and I can find justice because, like each member, even I pay the legal taxes, and is a respectful member of the society and hold equal rights. Please help me what steps to take.
